MEDIATION LOCATION

Oken Mediation is committed to making the mediation process as convenient as possible for the parties engaged in mediation.
We can conduct virtual and in-person mediation meetings at locations throughout the greater Los Angeles area and we are willing to travel to other locations throughout the nation. Oken Mediation coordinates with all parties to determine the best mediation format that will serve to facilitate resolution.
MEDIATION FEE STRUCTURES

Oken Mediation is pleased to provide flexibility with its fees and mediation times in order to accommodate the needs of the mediating parties. We will work with the parties/counsel to determine the best fees and mediation length of mediation as Oken Mediation charges based on a full day or half-day basis. The following initial deposits apply to standard mediations during the 2024 calendar year.

Non-Refundable Deposit Due Upon Scheduling Mediation Date is $2,500.

Mediations generally occur Monday – Friday between the hours of 9:00 a.m. and 5:00 p.m.
​
Initial telephonic pre-mediation conferences are extremely important and recommended to assist the mediator. If additional pre-mediation conferences are requested by the party(ies), the conference(s) will be billed at the standard hourly rate.

FEE NOTES
​
Matters scheduled for a full-day mediation are generally scheduled to begin at 9:00 a.m. and end at 5:00 p.m. The amount charged includes pre-mediation conferences with each party, reading/review of case materials and briefs and any travel time within the greater Los Angeles area.

​HALF DAY – Matters scheduled for a half-day mediation are allotted four (4) hours and are generally scheduled to begin at either 9:00 a.m. or 1:00 p.m., but start times are flexible. The amount charged includes a pre-mediation conference with each party, any travel time within the greater Los Angeles area and one hour of reading/review time. Oken Mediation may be available to continue mediation sessions into the afternoon or evening on half-day cases.

FACILITY COSTS – Conference room facilities can be arranged by Oken Mediation or by the parties. The facility fee, if any, will be the responsibility of the parties.

ALLOCATION OF FEES – All fees will be billed to and are due from the mediation participants in equal shares unless the parties agree to a different allocation and notify Oken Mediation of the agreed-upon allocation at the time the mediation is scheduled.
​
DEPOSIT – The non-refundable deposit of $2,500 must be received by Oken Mediation within three (3) days of the setting of a mediation date in order to reserve the mediation date and time. The remaining fee balance is due no later than (10) days before the mediation date.
​
CANCELLATION/POSTPONEMENT – Any mediation cancelled within five (5) business days of the scheduled date may be subject to forfeiture of 50% of the deposit amount, unless the mediation is rescheduled or David Oken's time can be rescheduled for another matter.
​
PAYMENT RESPONSIBILITY – The parties and their attorneys, if applicable, are jointly and severally responsible for payment of fees and costs.
